侵袭性医疗行为的“可允许范围内”原则与患者知情同意权

       【摘要】 医疗行为是以患者自身不可替代的生命、身体为对象进行的，医疗行为的结果不仅对患者有治疗疾病、拯救生命、恢复健康的作用，同时常常由于医疗行为的侵袭性，造成患者医源性身体损害的结果。因此，侵袭性医疗行为应在“可允许范围内”，且应在法律意义上得到行为对象的同意，使其实施合法化。患者知情权能否得到切实有效的保护，患者能否充分、有效的行使自己择医自主权，对切实维护其自身合法权益，改善医患之间的关系，减少或妥善处理医疗纠纷有着十分积极的意义。

      【Abstract】 The object of medical action is patient’s body and life which can’t be substituted by other else.The effect of medical action is not only to treat illness，safe life and regain health but also can bring about the medical injury to the patient because of its invading character.Therefore，the invading medical action should be acted in the alˉlowable range and be legally approved by the patient，as thus it is legality.There is a positive meaning to the pati

ent when the rights of informed consent be certainly and efficaciously protected and the rights of option be adequately and effectively carried out by the patient，which can improve the relationship between medical staff and patient and reduce the dissension.
